In compliance with the EU General Data Protection Regulation (GDPR), the Protection of Personal Information Act, 2013 (POPIA), and related data protection legislation, this policy describes how we collect, store and use your personal data. 

Privacy  is important to us. This document brings clarity to you what data is collected from you and how, in particular information about HearthCoach as a personal data controller, the purpose and legal basis of processing and the categories of personal data users, the storage period and an individual’s rights in relation to processing, so you can feel safe and secure your data will be only used for what was intended. 

This policy covers the personal information we collect when you interact with us via our online platforms, or during sessions taken online or in person. If you do not agree with this policy, please do not use newsletter, appointment or free pdf options on this site.

We are the controller of the data your provide us with in terms of GDPR if you have any concerns regarding our privacy policy, do not hesitate to contact us.

By visiting our website or using our products and services, you are the individual in terms of GDPR.

What information we collect from you 

The types of information can include the following: 

  • Identity data (including name and surname)
  • Contact data (including phone number, address and email address)
  • Usage data (including information about how you used our websites, products and services)
  • Other personal data you might provide us with during our individual sessions 

Why and on what legal basis we process information from you

We collect information from you so that we can provide you with the relevant service you require. 

We process your personal information based on your consent or/and to fulfill our contract. We may also process your information due to the legal interests that are pursued by us or to meet the statutory obligations that apply to us (e.g. tax reasons).

Data retention period

We keep your information if that is required to implement the purpose for which your information was collected.

If a law serves as the basis of data processing, we keep your information as long as the law requires us to.

If personal data is obtained based on consent, we shall keep and process your information until this is required for the service you required from us. If you withdraw your consent, we shall erase your information without delay.

If the processing of personal data is required for the implementation of a contract or due to the legal interests pursued by us, we shall keep your data for another five years after the service has been terminated.

How and when we collect information from you

We collect information about you when you provide it to us.

We collect information about you when you make contact through our online platforms in the contact, appointment, newsletter subscription or free pdf subscription form.

We collect information about you when we have individual or other sessions. 

How we use information we collect

We use the information provided to get in contact with you to agree on free discovery call, or send you more information that you have subscribed to or signed for. We use the information provided to provide you with our products and services you required.

We do not include automated adoption of decisions when processing your information.

What rights do you have

Request access to or correction or erasure of your personal information: You can update your basic profile information and modify or erase content that contains information about you by sending us an email. 

Opt out of Communications: You may opt out of receiving newsletter notification by contacting us to have your contact information removed from our email list. 

Restrict processing, request data portability or object do your personal information: You can exercise your rights by sending us an email.

However, please consider that your rights may be restricted by law and regulations or the rights of other individuals, which we verify accordingly with each request we receive and then act in accordance with its findings.

When exercising any of your rights above, you need to identify yourself accordingly in your request and clearly define your requests. In case doubt exists in connection with your identity we may request additional information or proof to confirm your identity.

We do our best for you to easily and without undue delay exercise your rights, no later than within one month of receiving your request. Considering the complexity and number of requests, this may be extended by no more than two additional months. In the unlikely event of an extension, we shall inform you about it within one month of receiving your request, providing you the reasons for the delay as well.

If we do not act upon your request, we shall inform you without delay, but no later than within one month of receiving your request, of the reasons as well as of the possibility to file a complaint with the supervisory authority, and to enforce legal remedies.

If your requests should be clearly unfounded or excessive, in particular because of their repetitive nature, we may charge you with a reasonable fee (considering the administrative fees) or for the implementation of the required measure or reject to act upon your request.

If you believe that your information is being processed in contravention of applicable regulations that govern the area of personal data protection, you can file a complaint with us via email. You may also file a complaint directly tih the supervisory authority for personal data protection.

Children 

Our Products are not directed to individuals under 18. We do not knowingly collect personal information from children under 18. If we become aware that a child under 18 has provided us with personal information, we will take steps to delete such information. If you become aware that a child has provided us with personal information, please contact us.
